Terms of service
Plain terms for a plain tool.
The short version
- Your content is yours. We get only the permission we need to show it back to you and, if you choose Cloud Vault, to store it encrypted.
- Everything on your phone is free. Cloud Vault Pro is a monthly subscription you can cancel any time; it runs until the end of the period you paid for.
- Use it legally and kindly. No malware, no abuse of the Cloud Speed service, no breaking other people’s rights.
- We are a small team. MogDrive is provided as it is, we fix problems quickly, and our liability is limited to what you paid us in the last twelve months.
1. The agreement
These terms are a contract between you and Octag AI LLC (“we”) for the MogDrive apps, the web app and the website (together, “MogDrive”). By installing, opening or signing in you accept them. If you use MogDrive for a company, you confirm you may bind that company. If you do not agree, do not use MogDrive. The privacy policy explains what we process and is part of these terms.
Before launch. Until the MogDrive apps launch, MogDrive is this website, a free web preview that runs in your browser on sample data, and a waitlist. Nothing is for sale and no account is needed; the plans in section 3 apply once they open. The preview is provided as it is, may change or go offline at any time, and keeps nothing you add after you reload.
2. Accounts
You may use MogDrive on a phone without an account. An account is needed for Cloud Vault Pro. You must be at least 13 years old (16 where that is the age of digital consent) and give accurate information. You are responsible for what happens under your sign-in; tell us at once if it is compromised. One person, one account: shared or resold accounts can be closed.
3. Plans, payments and refunds
Free
Everything that runs on your phone is free with no item cap, including the optional full on-device model, which you download once (about 0.5 GB). The free plan includes a limited allowance of Cloud Speed processing (shown in the app); when it is used up, Cloud Speed pauses until the next month or until you upgrade, while everything on the phone keeps working.
Cloud Vault Pro
A monthly subscription with the storage amount shown at checkout. It renews each month until you cancel from the account page, the billing portal or the App Store. Cancelling stops future charges; the service continues until the end of the paid period, after which Vault data is kept for 30 days for export and then deleted. If you exceed your storage amount, uploads pause until you free space or move to a larger plan.
Payments and taxes
Web purchases are processed by Stripe; App Store purchases by Apple under Apple’s terms. Prices are shown in US dollars and may exclude taxes that we must add by law. If a payment fails we may retry it and, after notice, suspend the paid feature.
Refunds
Purchases made through the App Store are refunded by Apple under its policy. For web purchases, email hello@mogdrive.com within 14 days of a first purchase and we will refund it if you have not used a meaningful part of the paid service (for Cloud Vault Pro, if less than 1 GB has been stored). Where the law gives you a stronger right, that right applies.
4. Your content
Everything you save in MogDrive is yours. You give us only the permission needed to run the service: to process your items on your device or, when you choose a cloud engine, on our servers as described in the privacy policy; to store encrypted Vault data; and to deliver a shared island to the people you give the link to. We claim no ownership, we do not use your content to train models, and the permission ends when you delete the content or the account, except for copies in backups that expire within 30 days.
You are responsible for having the right to save and share what you put in MogDrive. If someone claims that content you shared infringes their rights, email hello@mogdrive.com with the link and the details; we remove what the law requires and tell you.
5. Acceptable use
Do not use MogDrive to break the law, to store or share malware or illegal content, to harass anyone, or to infringe other people’s rights. Do not probe, overload or scrape the Cloud Speed service, the website or other users’ shared islands, and do not attempt to extract our models or bypass plan limits. We may suspend or close accounts that do, and we may report illegal activity.
6. Third-party services
Songs, books and links are looked up with services such as Apple Music, Spotify and Open Library under their terms. Playback happens in their players; we never store protected media, only what the item is about. Sign-in uses Apple, Google or Firebase email sign-in. We are not responsible for those services, and they may change or end their support at any time.
7. Changes to the service
We improve MogDrive continually and may add, change or retire features. If we retire something you paid for, we give at least 30 days’ notice and, for a prepaid period you cannot use, a proportional refund. If we change these terms in a way that affects your rights, we tell signed-in users by email or in the app before the change applies; continuing to use MogDrive after that means you accept the new terms.
8. Warranties and liability
MogDrive is provided “as is” and “as available”. Search results, transcriptions and automatic organisation are produced by machine learning and can be wrong; check anything that matters. We do not promise that MogDrive will be uninterrupted or error-free, and we are not a backup of last resort: keep your own copies of anything irreplaceable. To the extent the law allows, we exclude implied warranties and are not liable for indirect, incidental or consequential loss, loss of data or profit. Our total liability for claims connected with MogDrive is limited to the amount you paid us in the twelve months before the claim, or 50 US dollars if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
9. Ending the agreement
You can stop using MogDrive at any time and delete your account from the account page or inside the app. We can suspend or close an account that breaks these terms, after telling you unless the breach is serious or the law prevents notice. Sections 4, 8, 10 and 11 survive the end of the agreement.
10. Governing law and disputes
These terms are governed by the laws of the United States and of the state in which Octag AI LLC is organised, without regard to conflict-of-law rules, and disputes are heard in the courts there, except that consumers in the European Economic Area, the United Kingdom and Switzerland keep the protection of the mandatory laws and courts of their home country. Before going to court, email us and give us 30 days to put things right.
11. Everything else
These terms and the privacy policy are the whole agreement between us about MogDrive. If a part is unenforceable, the rest stays in force. We may assign the agreement as part of a sale of the business; you may not assign it. Notices to us go to hello@mogdrive.com; notices to you go to the email on your account. Apple is not a party to these terms and has no obligation to support the app; where you got MogDrive from the App Store, Apple’s standard end-user terms also apply and Apple may enforce these terms as a third-party beneficiary.
